New York State Sexual Harassment Rules Become Effective Today!

The New York State Department of Labor has finalized its rules. Portions of the law go into effect today.  These new rules apply to all businesses regardless of size.

Last week we hosted a webinar by the noted labor law firm of firm of Jackson Lewis P.C.  We urge you to review it. The webinar has been archived HERE.

If your company has not yet adopted a sexual harassment policy, then we suggest you adopt the model program that has been approved by the N.Y. State Department of Labor.  This is a comprehensive system that will include a number of new requirements including adoption of a model prevention policy, annual training, training for new employees, a complaint process, and employee notifications.

The details of the program can be found on the Department of Labor’s website HERE.   The newly released information includes:

  • Updated model sexual harassment prevention policy
  • Updated model sexual harassment complaint form
  • Updated model training (script book and PowerPoint presentation)
  • Updated minimum standards for sexual harassment prevention policies and trainings
  • Updated FAQs

For employers, the elements necessary for the State of New York model program can be found HERE.

The NY State Department of Labor will offer both in-person and webinar training sessions to help employers understand the new requirements. A schedule of these events will also be announced in the near future online HERE.

Obviously you should consult your own legal counsel or labor expert.
